过境货物是指由境外启运，在中国边境不论换装运输工具与否，通过中国境内陆地继续运往境外的货物。过境货物由中国境内的经营人代理货物的所有者，向海关办理手续。中国海关对过境货物过境运输有如下要求：对同我国签有过境货物协定的国家的过境货物，或属于同我国签有铁路联运协定的国家收、发货的，按有关协定准予过境；对于未同我国签有上述协定国家的过境货物，应当经国家运输主管部门批准并向入境地海关备案后准予过境。
　　过境货物自进境起到出境止，属海关监管货物，应当接受海关监管。未经海关许可，任何单位和个人不得开拆、提取、交付、发运、调换、改装、抵押、转让，或者更换标记。
　　装载过境货物的运输工具，应当具有海关认可的加封条件和装置。海关认为必要时，可以对过境货物及其运输车辆或运载设备加封。承运人和经营人，应当负责保护海关封志的完整，任何人不得擅自开启或损毁。
　　海关认为必要时，可以查验过境货物。海关在查验过境货物时，经营人或承运人应当到场。按照海关要求负责搬移货物，开拆或重封货物的包装，并在海关查验记录上签字。
　　过境货物自进境之日起超过3个月未向海关申报的，海关按《中华人民共和国海关法》第二十一条有关规定处理。
　　过境货物向海关申报后，应当自进境之日起6个月内运输出境。在特殊情况下，经海关同意可以延期，但延长期不得超过3个月。
　　过境货物如在规定时间内不能出境，海关按《中华人民共和国海关法行政处罚实施细则》第十一条（七）的规定处理。
　　过境货物进境后因换装运输工具等原因需卸地储存时，应当经海关批准并在海关监管下存入经海关指定或同意的仓库或场所。
　　过境货物由于不可抗力的原因，被迫在运输途中换装运输工具，起卸货物或遇有其它意外情况时，经营人或承运人应当立即报告所在地海关或附近海关，接受海关监管。
　　过境货物在境内发生灭失和短少时（除不可抗力的原因外），应当由经营人负责向出境地海关补办进口纳税手续。
　　中国政府明令禁止过境的货物不得过境。
